Licensing Act 2003 applications

Under the Licensing Act 2003, Responsible Authorities and others have 28 days from the application date for a Premises Licence/Club Premises Certificate (and variation) to make representation to the Licensing Authority. 

Representations must be made in writing and it is an offence under Section 158 of the LA2003 knowingly or recklessly to make a false statement in connection with an application. Those who make up a false statement may be liable on summary conviction to a fine of any amount.

Application for the Review of a Premises Licence on the following grounds:

PC 138 Welch on behalf of the Chief Constable of Bedfordshire Police believes the following licensing objectives have been undermined:

  • The prevention of crime and disorder
  • The protection of children from harm

LAMBERTS is located in a busy road in Bedford town centre. The area is synonymous with crime and ASB much of it associated with the consumption of alcohol.

On Friday 5th October 2018, a test purchase operation was conducted in the area. This involved the use of two 15 year old police cadets. When they entered the store they selected two bottles of Stella Artois lager and took them to the till. They were not prompted for any ID and were sold the alcohol.The person who sold the alcohol on this occasion was a male called ROHIT. He proved his identity by the production of a drivers licence and was issued with a £90.00 fixed penalty shortly after the sale was made.

On Thursday 22nd November 2018, a further test purchase operation was carried out, this time with two volunteers, aged 15 and 16. When they entered the store they selected a bottle of Echo Falls wine. They took the item to the counter where they paid, again without being prompted to provide any ID. On this occasion the male who sold the alcohol was a male who was identified as Mohammad ALI. When his details were verified, very shortly after the sale, he was also given a £90.00 fixed penalty notice.

On neither occasion was the DPS present
