Appeal by FCC Environment Ltd against the decision of Bedford Borough Council to refuse in part to grant a Certificate of Lawful Use or Development.
Certificate applied for: the use of three existing rail sidings and infrastructure, offload area, and internal site access road for the importation of materials, including waste, by rail for onward transportation to other destinations via Green Lane.
Certificate granted for: Use of the sidings limited to use for importation of soil and soil forming materials for the purposes of soil placement works and restoration works.

FCC Environment Ltd (the appellant) has appealed to the Secretary of State MHCLG against the Council’s decision.
The appeal will be heard at an Inquiry beginning at 10am on 23 March 2023 at Council Chambers, Borough Hall, Cauldwell Street, Bedford, MK42 9AP. It is scheduled to last three days.
