Noise Pollution

Noise arising from the activities of residents and businesses can be investigated by the Environmental Health & Trading Standards Service under the Environmental Protection Act 1990.

 

We can take action where we are satisfied that that noise amounting to a statutory nuisance exists, or is likely to occur or recur.

 

The law does not specify noise levels or time limits, but requires an objective judgement to be made by officers, based upon factor including:

  • How often the noise occurs
  • Its duration
  • How loud it is
  • The time of day/night
  • The character of the noise (whether it has any particularly annoying characteristics)
  • The nature of the area

 

Just because the noise is audible, it does not necessarily mean it is a statutory nuisance.  Noise nuisance is judged from the average persons viewpoint in line with legislation and guidance.
