Licensing (Consultation)
Environmental Health & Trading Standards act as consultees
to other service areas within the Borough Council. As such we
are asked to comment on various applications made members of the
public and local businesses regarding the impact any proposals may
have on existing residents and the environment as a whole.
Premises Licences and Club
Certificates
The Licensing Act 2003 came into force on the 24th November 2005
and established a single integrated scheme for licensing premises
that are to be used for any of the following activities:
a) Performance of a play;
b) Exhibition of a film;
c) Indoor sporting event;
d) Boxing or wrestling entertainment;
e) Performance of live music;
f) Playing of recorded music;
g) Performance of dance;
h) Entertainment of a similar description to (e),
(f), (g), above;
i) Supply of alcohol
j) Provision of Late night refreshment.
The Community Regulation team are consulted on all applications
and have the opportunity to make comment on issues relating to:
- Public Safety;
- The prevention of Public
Nuisance;
- The Protection of Children from
Harm
Public Safety
The team look at any issues that may affect the health, safety and
welfare of customers. The team can not duplicate or require a
higher standard of safety than already required under existing
Health and Safety legislation.
Public Nuisance
The team look at the potential for noise nuisance, light pollution,
noxious smells and litter from the use of the premises.
Protection of Children from Harm
The team look at how children will be protected from exposure to
adult entertainment, and how under age sales will be prevented.

Street Trading / Tables and chairs
consent
Any person wishing to sell articles in the street, or place
tables and chairs on the highway requires a licence from the Local
Authority. The Commercial Regulation team are consulted on
all applications and have the opportunity to make comment or impose
conditions on the grounds of health and safety and the potential
for annoyance or nuisance from the trader. More information

Sex Establishments
Any shop that sells sex toys, books or videos usually requires a
licence from the Local Authority. The Commercial Regulation
team are consulted on all applications and have the opportunity to
make comment or impose conditions on the grounds of health, safety
and welfare, including sexual health matters. More

Animals
Any establishment that boards, breeds, offers for sale or for
any commercial gain requires a licence from the Local
Authority. Any individual that keeps ‘Dangerous Wild Animals’
also requires a licence form the Local Authority. The
Commercial Regulation team are consulted on all applications and
carries out visits to all licensed establishments to check for
issues that relate to the health, safety and welfare of both the
animals, employees and visitors to the premises. More
