Yes, we are aware of this previous use of the site.

2. What priority for investigation has Bedford Borough Council assigned

to the site?

By virtue of Part IIA of the Environmental Protection Act 1990, the Council

was required to formulate a Strategy to detail how it plans to meet its duty to

inspect land in its area, and identify contaminated land under sections 78B

and C of the Act. This site has been included in Bedford Borough Council’s

list of sites to investigate. It has been determined to be a medium priority site

for inspection.

3. Will the site be investigated within the next five years under Part 2A of

the Environmental Protection Act 1990?

Based on the information currently available, it is not likely that the site will be

inspected in the next five years under Part 2A of the Environmental

Protection Act 1990. It is possible that this may change, should new

information come to light.

As reported in March 2017, local authorities were provided an extra £25 million due to the Cheshire West outcome of the Supreme Court ruling. I would like to know the following as an freedom of information act request please.

Under the provisions of the Freedom of Information Act, the authority must state whether or not the information exists and I confirm that we do hold part of the information you requested.

a)The number of drivers currently holding a taxi/PH licence - 790

Regarding question b) The number of drivers who hold a licence who hold a criminal conviction. Please detail the offence, and the date of the offence. Please detail whether the licence was awarded at original application, or on appeal.

However, the Freedom of Information Act 2000 does not oblige the Council to comply with a request for information if it estimates that the cost of complying with the request would exceed the “appropriate limit.”

This appropriate limit has been set in the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 which provides that for a local authority the appropriate limit is £450. This is calculated by reference to a maximum of 18 hours being taken and the cost of staff time being set in the Regulations as £25 per hour.  The Regulations also say that In calculating the amount the Council may, “for the purpose of its estimate, take account only of the costs it reasonably expects to incur in relation to the request in: (a) determining whether it holds the information, (b) locating the information, or a document which may contain the information, (c) retrieving the information, or a document which may contain the information, and (d) extracting the information from a document containing it.” We calculate the cost of retrieving the information as follows:

Searching 790 records x a minimum of 10 minutes each = 131 hours

The Council has therefore decided to refuse your request.

Regarding question c) Please provide the number of drivers who were refused licences due to criminal convictions in 2017. Please detail the type of offence, and whether this was a new application or a renewal.

You requested the number of drivers who were refused licences due to criminal convictions in 2017. Please detail the type of offence, and whether this was a new application or a renewal.

Pursuant to Section 17 (1) of the Act, the Council

1. States that question c is exempt information.

2.  Specifies, that the exemption in question is the subject of an absolute exemption contained within Section 21(Information accessible to applicant by other means)of the FOI Act (FOIA).

An explanation follows below.
