Putting the AP census on a statutory basis: • means that providers do not need to obtain parental or pupil consent to the provision of information • ensures providers are protected from any legal challenge that they are breaching a duty of confidence to pupils, and • ensures that returns are completed by providers

Could you please inform me of the properties taken over by the

Local Authority under Compulsory Purchase Orders since 2003.

We  can confirm that land for the Bedford Western Bypass (Kempston – Biddenham) was acquired under CPO powers from Bedfordshire County Council.  The northern section of the Bedford Western Bypass (Bromham – Clapham) was acquired under CPO powers from Bedford Borough Council.

Thank you for your request for information about Units Caxton Park, Caxton

Road, Elms Farm industrial Estate, Bedford which we received on 11th December

2018. Your request has been considered under the Environmental Information

Regulations 2004.

 

1. Has the site been identified for inspection or further review under the Council’s

Contaminated Land Strategy (or other Part IIA undertaking)? If so, please

describe the priority status/risk ranking of the site and the likely timescale for any

further scrutiny of the site.

By virtue of Part IIA of the Environmental Protection Act 1990 the Council was

required to formulate a Strategy to detail how it plans to meet its duty to inspect

land in its area and identify contaminated land under sections 78B and C of the

Act. This site is not listed on our prioritised list of potentially contaminated sites,

and so it will not be assessed as part of our inspection arrangements. Please

note that this is based upon the information which we currently hold, and is

subject to change should relevant information come to light.

2. Are there any known contamination issues associated with the site or in the near

vicinity e.g. in terms of former or current contaminative site uses, leaks or spills of

any oil/chemical substances etc.? If there have been any intrusive investigations

at the site or near vicinity, please provide dates and titles of any reports and

confirm whether the reports are publicly available.

We are not aware of any contamination issues at the site, nor of any intrusive

investigations either at the site, or in the near vicinity.

3. Please provide the following details of any current or former landfills located

Please be aware that we hold only limited records of waste deposition. We would

Bedfordshire Council, where excavation and waste deposition records for the

Bedford Borough area are held (switchboard: 0300 300 8693).

enforcements associated with the site or adjoining properties, e.g. noise, odour or

dust issues/complaints? If yes, what was the nature of the issue and what was

the outcome?

No, we are not aware of any current or former nuisance issues, prosecutions or

enforcements associated with the site or adjoining properties.

5. Are there any known private water supplies recorded on your Local Authority

No, there are no private water supplies recorded on your Local Authority Private

Water Supply Register, within 2km radius of the site.

6. Do you hold any records of flooding at the subject site?

There have been no reported incidents of flooding to the Borough Council at this

location.

Flooding from rivers – there is no risk from flooding from adjacent rivers on the

Environment Agency map.

There is no flood risk from reservoir flooding shown on the Environment Agency

map.

Surface water flood risk – there are areas of low, medium and high risk flooding

from surface water on the carriageway areas outside the units. There is an area

of low risk flooding from surface water to the east and north of units.

The enquirer is advised to view the Flood risk from surface water map available

on Gov.uk.

7. Please provide details of any LAAPC/LAPPC authorisations licensed to the site or

Are there any records of petroleum storage at or in the immediate vicinity of the site, either in above ground or below ground tanks?   

If yes:

1.      How many tanks were there and what was their capacity? Please provide a plan showing the tank locations if possible.

2.      How long were the tanks in use/known to be present on site?

3.      What is the current status of the tanks? If they have been decommissioned by filling, please detail fill material.

4.      Are there any known leaks or spills associated with the tanks?

5.      Are there any records of integrity testing? If so when was this undertaken and what were the results?

The annual software cost, including Housing Benefit, NNDR, Document Management and other services is currently £76,823.37 plus VAT.

The Council is unable to provide the information requested.

For the 2017/18 Council Tax annual billing exercise, a total of 72,767 Council Tax bills were posted and the total postage cost was £24,657.11.

The Council also incurred additional costs for printing the Council Tax and NNDR annual bills which totalled £3,128.28 and from the external mailing company used for posting the Council Tax bills which totalled £1,559.52.

At Spring Budget 2017, the Government announced 3 business rates relief schemes, one of which is ‘discretionary relief’ for which a total of £175m has been allocated in aggregate to billing authorities in England in respect of 2017/18.

Please confirm how much of this ‘discretionary relief’ your authority has thus far granted to its non-domestic ratepayers in relation to the 2017/18 rate year.

I would like to place a request for information that pertains evidence, in any recorded format, to any entity cited in the bibliography and reference list, which would constitute a contravention of any constitution, statute, treaty, or convention, or crime by any criminal and penal code cited in the bibliography, and in the alleged assertion of ‘acting as an accessory, accomplice, or perpetrator’ in the specific alleged assertions of practicing any act, information, or data cited in the bibliography.  

Further to your request for information dated 20/12/17, I can confirm that the information you requested may be held under the Freedom of Information Act 2000. However, the Freedom of Information Act 2000 does not oblige the Council to comply with a request for information if it estimates that the cost of complying with the request would exceed the “appropriate limit.”

This appropriate limit has been set in the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 which provides that for a local authority the appropriate limit is £450. This is calculated by reference to a maximum of 18 hours being taken and the cost of staff time being set in the Regulations as £25 per hour.  The Regulations also say that In calculating the amount the Council may, “for the purpose of its estimate, take account only of the costs it reasonably expects to incur in relation to the request in: (a) determining whether it holds the information, (b) locating the information, or a document which may contain the information, (c) retrieving the information, or a document which may contain the information, and (d) extracting the information from a document containing it.”

 

The Council has therefore decided to refuse your request. As this would involve the whole of Bedford borough Council employees to look at all documents held within their remit.

 

Also, under section 14 (1) of the FOI Act your request is a burden to the authority. The effort required to meet the request will be so grossly oppressive in terms of the strain on time and resources of the Bedford Borough Council and therefore will not comply.  Our reasons are as follows: your request appears to be part of a completely random approach, lacks any clear focus, or seems to have been solely designed for the purpose of ‘fishing’ for information without any idea of what might be revealed.  The authority would have to expend a disproportionate amount of resources in order to meet your request.

I can confirm that the Council did receive a complaint regarding   Wybridge Close,  on the 28th July 2017. I am unable to provide you with the details of the individual that contacted the Council as this information is protected under Data Protection legislation. However I can tell you that the complaint was discussed by  officers from the Council with your housing provider, Bedfordshire Pilgrims Housing Association (BPHA) and it was agreed that BPHA would investigate the matter as it related to an alleged breach of tenancy.  Thank you for your request for information about details of actions undertaken relating to an infestation of rats at  Wybridge Close in 2005-6 and in 2016 which we received on 27th December 2017. Your request has been considered under the

Bedford Borough Council became a Unitary Authority in April 2009. No records are available from before this date, therefore we cannot assist you with any information relating to matters that may have been reported to us in 2005/6. I can confirm that we do hold a record relating to rat activity in the Wybridge Close area which was raised in 2016 although I am unable to inform you of the identity or address of the individual that raised this matter with the Council as this is protected by Data Protection legislation. Our records show that a series of treatment visits was undertaken by the Council’s Pest Control officer and the matter was then closed.
