Appeals
If your application is refused or if the Council does not make a decision on it within the given period, you have the right of appeal to the Planning Inspectorate who will determine the appeal. You must appeal within 6 months from the date of the decision notice or if no decision notice has been issued then 6 months from the date that the decision was due to be made.
There are three types of appeals:
Written Representations – the applicant and the Council provide written statements to the Planning Inspectorate. A Planning Inspector visits the site and then issues a decision. The majority of appeals tend to be written representations.
Hearing – both parties discuss issues led by the Planning Inspectorate, following the exchange of statements, as above.
Public Inquiry – all parties present their case orally and are cross-examined by the opposing parties in front of the Planning Inspector. The Planning Inspector will visit the site with all parties present. Public inquiries tend to be lengthier than the other two types of appeals.
